In a lawsuit involving him, the Peoples Democratic Party, PDP, and two others, the Appeal Court in Abuja ruled in favor of factional governorship candidate of the PDP in Ogun State, Segun Sowunmi.
According to the lawyers, the judgement in Sowunmi’s suit against the party, Ladi Adebutu and co, means that unless otherwise ruled, he remains the candidate of Ogun State’s primary opposition party.
The appellant, Sowunmi, had complained to the lower court that the party’s Ogun State Executive acted in a biased manner when they allegedly purchased nomination and interest forms for Adebutu, the third respondent, without doing the same for the other candidates, including himself, who purchased the forms legally.
The lower court was believed to have refused jurisdiction hurriedly, citing Section 285(14) Paragraphs (A)-(C) of the 1999 Constitution.
Dissatisfied with the lower court’s judgment, the appellant, Sowunmi, quickly filed an appeal through his lawyer, Mawah Monday.
As a result, his lawyer filed an appeal and developed three grounds of appeal, which were granted on Friday.
The Court of Appeal decision, which lasted over an hour and was presided over by Justice Chide Nwaoma Uwa, accepted the appeal and overturned the Lower Court finding.
